1. Acceptance of Terms

By accessing or using FireflyLights.com, requesting information, submitting a form, accepting an estimate, or purchasing services from Firefly Lights, you agree to these Terms & Conditions. If you do not agree, please do not use the Site or our services.

2. Services

Firefly Lights provides products and services that may include permanent exterior lighting, architectural lighting, holiday or accent lighting, misting systems, solar-related services, maintenance, repairs, upgrades, and related consultation, scheduling, and support. Service availability may vary by location, project type, season, weather, staffing, materials, and site conditions.

3. Estimates and Proposals

• All estimates, quotes, and proposals are subject to revision based on field verification, scope changes, access limitations, code requirements, product availability, and site conditions.
• Quoted pricing may expire if not accepted within the stated validity period.
• Promotional offers, financing terms, discounts, and incentives may be modified, limited, or withdrawn at any time unless confirmed in writing.

4. Payments

• Deposits may be required before scheduling, ordering materials, fabrication, or installation.
• Remaining balances are due according to the payment schedule in your estimate, invoice, contract, or service agreement.
• Financing offers, card-processing fees, convenience fees, or other lawful charges may apply when disclosed.
• Failure to make timely payment may delay or suspend scheduling, installation, warranty service, or future work.

5. Scheduling and Access

• Installation and service dates are estimates and are not guaranteed unless expressly confirmed in writing.
• You agree to provide safe and reasonable access to the property, work areas, utilities, and any necessary approvals.
• We are not responsible for delays caused by weather, utility interruptions, manufacturing lead times, permit issues, HOA restrictions, acts of God, labor shortages, customer-caused delays, or other events outside our reasonable control.

6. Customer Responsibilities

• You represent that you own the property or have authority to approve the work.
• You agree to disclose known hazards, wiring concerns, roof issues, structural concerns, irrigation lines, or other conditions that may affect the project.
• You are responsible for obtaining any HOA, landlord, or third-party approvals unless we specifically agree otherwise in writing.

7. Warranties and Service Limitations

Lighting Systems: Unless otherwise stated in writing, product warranties generally apply to covered manufacturer defects only. Labor, trip charges, diagnostics, removal/reinstallation, and related service costs are not included unless covered by a separate warranty or service agreement.

Misting Systems: Unless otherwise stated in writing, product warranty coverage may apply to covered product defects, but parts, labor, maintenance, seasonal service, freeze damage, clogging, misuse, and ordinary wear may be excluded.

Extended Coverage: Optional warranty or service plans may be available and, if purchased, will be governed by their own terms.

8. Cancellations, Returns, and Refunds

• Custom, special-order, fabricated, or installed products are generally non-returnable and non-refundable.
• Deposits may be non-refundable once materials are ordered, project planning begins, or schedule time is reserved.
• Approved cancellation terms, restocking charges, or administrative charges may apply as described in your contract or invoice.

9. Website Use

• Use the Site only for lawful purposes.
• Do not interfere with the Site, servers, networks, forms, security controls, or user experience.
• Do not submit false, misleading, infringing, or unauthorized information through our forms or communications systems.

10. Intellectual Property

All content on the Site, including text, graphics, logos, images, layout, design elements, downloads, and branding, is owned by or licensed to Firefly Lights, LLC and may not be copied, reproduced, republished, or used without prior written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Firefly Lights will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost use, lost data, or delay-related damages. Our total liability arising out of or related to the Site or services will not exceed the amount actually paid to us for the specific service giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Firefly Lights and its owners, employees, contractors, affiliates, and agents from claims, damages, liabilities, losses, and expenses arising out of your misuse of the Site, your breach of these Terms, your violation of law, or your negligence or misconduct.

13. Communications Consent

By submitting a form, inquiry, or contact request, you consent to receive communications from us related to your request and, where you separately opt in, promotional messages by phone, email, and SMS. Consent to receive promotional text messages is not a condition of purchase. Message frequency varies. Carriers are not liable for delayed or undelivered messages. 14. Governing Law

These Terms & Conditions are governed by the laws of the State of Arizona, without regard to conflicts of law principles.

15. Changes to These Terms

We may revise these Terms & Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
